LIVE’s Spin Into Summer Web Trivia Rules
OFFICIAL RULES
I. NAME OF SPONSOR(S)
American Broadcasting Companies, Inc. (Hereinafter collectively referred to as “Sponsor”) 77 West 66th Street, New York, NY 10023.
II. ELIGIBILITY:
Entrants must be 18 years of age or older as of May 5th, 2014 and legal resident of the 50 U.S., D.C. or Canada (except the Province of Quebec), with the exception of Guam, Puerto Rico and all other U.S. territories and possessions and where prohibited by law.
Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for American Broadcasting Companies, Inc., Buena Vista Television, LLC, WABC-TV, LIVE with Kelly and Michael, any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the sweepstakes or supplying the prize, and their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to nominate or be nominated. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses. "Household members" shall mean people who share the same residence at least three months a year.
III. HOW AND WHEN TO ENTER
NO PURCHASE NECESSARY.
Viewers should watch LIVE with Kelly and Michael from May 5th, 2014 thru June 27th, 2014 (with the exception of the week of June 16-20, 2014). There will be one question for each show day that will appear online from 9:00AM ET to 11:59PM ET each weekday, starting Monday May 5th, 2014. The question will be about something that was said or appeared on a previous show and/or a statement of common knowledge.
Viewers can enter their “Answer” on the LIVE with Kelly and Michael Facebook page. Entrants will receive (1) one entry into the weekly drawing for the correct “Answer” they submit. The “Answer” for a given show day can be submitted between the hours of 9:00AM ET and 11:59AM (ET). Viewers can enter once every 24 hours during the sweepstakes.
By selecting the “LIVE’S SPIN INTO SUMMER TRIVIA WEB EDITION” option on www.livekellyandmichael.com, viewers will be sent to the LIVE with Kelly and Michael Facebook page to enter the Sweepstakes. To enter on Facebook, go to the LIVE with Kelly and Michael Facebook page www.facebook.com/LIVEKellyandMichael, “Like” the page and then click the sweepstakes tab on the Facebook page, which will take you to the entry form. On that form, enter requested contact information (name, address, telephone number(s), etc.) that will be used to contact you if you are selected as a winner.
LIVE can provide no technical support and accepts no responsibility for insuring the receipt or successful submission of your registration and/or ”Answer”.
For FACEBOOK entries, you understand that you are providing your information to Sponsor and not to FACEBOOK as this Sweepstakes is not sponsored, endorsed or administered by FACEBOOK, nor is FACEBOOK associated with this Sweepstakes in any way. Any questions, comments or complaints regarding this Sweepstakes must be directed to the Sponsor, and not to FACEBOOK.
Sponsor is not responsible for “Answers” not received. Sponsor is not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. If for any reason the sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of the sweepstakes, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the sweepstakes. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any Web-site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation in or downloading any materials from this sweepstakes.
Odds of winning will depend on the number of entries received each sweepstakes period as listed in the chart below.
Limit one (1) Entry every 24 hours per person/email address during each weekly sweepstakes period.
Mass entries or entries generated by a script, macro or use of automated methods will be disqualified. If for any reason the sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of the sweepstakes, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, modify or suspend the sweepstakes. If canceled, Sponsor reserves the right at its discretion to determine the winner using all non-suspect eligible entries received up to the time of cancellation. Sponsor is not responsible for failed, partial, delayed or garbled computer transmissions, or for technical failures of any kind in connection with entries or the entry process, including but not limited to electronic malfunction or damage of any network, hardware or software. In the event of a dispute over an electronic entry, prize will be awarded to the authorized subscriber of the e-mail account, not the name on the entry form.
IV. HOW AND WHEN WINNERS WILL BE SELECTED AND NOTIFIED
One winner per week (with the exception of the week of June 16-20, 2014) from seven (7) separate weekly entry pools will be selected at random, one each Monday following the close of the entry period from the entrants with the correct answer from all the submissions received in any weekly entry period.
Sponsor may or may not draw and/or announce the winner’s name on air.
Winners will be notified by telephone each Monday following the end of an entry period, starting 5/12/14. If contact with the winner is not made within one week (7 days) the winner will be disqualified and an alternate will be selected from the remaining valid entries from the same entry pool. Failure to timely comply with any requirement of these terms and conditions will result in the winning entrant being deemed ineligible for any prize. Each Canadian resident who is a potential winner will be required to answer correctly a mathematical skill testing question without assistance of any kind whether mechanical or otherwise to be declared a winner and be eligible to collect a prize.
In the event winner is deemed ineligible, fails to comply with sweepstakes procedures, or is not available to claim prize during specified dates, then an alternate winner will be selected at random from the same entry pool as the original entry was selected.
Limit one (1) prize per person for the duration of the sweepstakes.
Final determination of winners is always conditional on verification of eligibility and compliance with all rules and procedures.
V. PRIZES
The prizes will be merchandise or trip package valued at up to $5,000 (“Prize”). If the actual value of a prize is less than the stated ARV, the difference will not be awarded. Any depiction of a prize is for illustrative purposes only. Prize is not redeemable for cash or transferable, except it is transferable to a surviving spouse residing in the same household. No substitution allowed except, at Sponsor’s sole discretion, a prize of equal or greater value may be substituted. Sponsor will not replace any lost, mutilated or stolen tickets, travel vouchers, certificates or prizes. Prize elements may not be separated. Airline tickets issued in conjunction with the prize are not eligible for frequent flyer miles, and no code share flights may be used. Prize cannot be used in conjunction with any other promotion or offer. The prize winners shall be solely responsible for any applicable federal, state, provincial, local taxes and/or local laws and regulations, and the reporting consequences thereof, and for any other fees or costs associated with the prizes. Winner will receive an IRS Form 1099 reflecting the final actual value of any prize valued at $600 or more.
The ARV's of all prizes are furnished by the prize suppliers. For travel prizes where air transportation is included, the round-trip coach-class air transportation element of the prize begins and ends at a major commercial airport near winner's residence or in some cases from selected gateways as designated in the travel prize package. Sponsor reserves the right to structure travel route in its sole discretion. If a winner lives within 100 miles of Prize trip destination, air transportation will not be provided but ground transportation may be arranged in Sponsors sole discretion. Trips must be completed within one (1) year of notification of winning, unless otherwise stated by Sponsor and/or prize supplier(s) in their sole discretion. Trips must be booked at least twelve (12) weeks prior to travel dates or on a timeframe set by Sponsor and/or prize supplier(s) in their sole discretion, which will be disclosed in travel documentation. No extension or change of trip dates permitted once trip dates have been confirmed by Sponsor. The prize restrictions/conditions stated herein are not all-inclusive and may be subject to additional restrictions/conditions, which will be stated in the Affidavit/Release (described below) and/or trip prize travel documents. Trip is subject to air/ground travel availability, hotel/stateroom availability, holiday and blackout dates and all other prize and travel restrictions, as applicable. If trip has a guest component, winner and guest(s) must travel together on the same itinerary (in Sponsor's and/or prize supplier(s) sole discretion). If a travel prize winner is a resident of a jurisdiction that deems him/her to be a Minor, he/she must be accompanied by his/her parent/legal guardian and such person must accompany the winner as the travel guest. If travel guest is a resident of a jurisdiction that deems him/her to be a Minor, he/she must be accompanied by his/her parent/legal guardian and such person must be the winner. If winner elects to travel without a guest(s), no additional compensation will be awarded. If a Prize trip is outside the U.S. or Canada (if winner is a resident there), winner and guest(s) (if applicable) are solely responsible for obtaining all necessary travel documents including passports and visas. The U.S. State Department requires all international travelers to present a government issued passport for U.S. Customs re-entry after air, land or sea travel. If trip has a rental car component, winner and/or a guest(s) (if applicable) must have a valid U.S. driver's license, be 25 years of age or older, and have at least one major credit card in good standing. In the event a winner or a trip travel guest(s) does not have a valid U.S. driver's license, is under 25 years of age, or does not have at least one major credit card in good standing, then rental car component of prize will be forfeited and remaining elements of trip shall constitute full satisfaction of said prize. Prize winner and guest, if any, must travel together on the same itinerary and all trip components must be taken together on the same trip. If any Prize winner elects to travel without the allotted number of guests, no additional compensation will be awarded. In the event that a prize component is not available during the time of the trip for whatever reason (e.g., weather conditions), then remaining elements of prize or prize components shall constitute full satisfaction of Sponsor’s prize obligation to winner and no additional compensation will be awarded in lieu thereof. Prize winner and/or his/her travel guest(s) must have/present at least one major credit card in good standing in order to check into a hotel, cruise or resort. All other expenses and incidentals not specifically mentioned as being included are excluded and are winner's sole responsibility including, but not limited to, taxes, air transfers, government fees, unspecified ground transportation, meals, gratuities, hotel incidentals, telephone calls, port charges and taxes, government fees, shore excursion(s), souvenirs, gift shop purchases, spas, meals in alternate dining venues, travel documents, service charges and travel insurance premiums, trip and travel insurance, and required immunizations if applicable.
VI. RELEASES
By participating, entrants agree to be bound by these official rules and the decisions of the Sponsor, which shall be final in all respects.
By participating in the sweepstakes and/or accepting any prize that they may win, entrants agree to release American Broadcasting Companies, Inc., Buena Vista Television, LLC, WABC-TV, LIVE with Kelly and Michael, Facebook, their respective parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the “Released Parties”) from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in the sweepstakes and/or acceptance or use of the prize.
Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, in any media now known or hereafter created or conceived, worldwide in perpetuity, or on a winner’s list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation.
To claim prize winner must: (a) provide proof of winner’s age, residency, and legal status; (b) sign and return eligibility, publicity, liability, rules compliance and any other releases requested by Sponsor; and (c) have winner’s intended guest(s) or travel companion(s), if any, sign and return releases requested by Sponsor; all within the time period(s) specified by Sponsor.
VII. MISCELLANEOUS; WINNERS’ LIST
Void where prohibited. All federal, state and local laws and regulations apply.
Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify and/or suspend the sweepstakes in the event of tampering or other circumstances, including but not limited to acts of God or civil disturbance that render it impractical or impossible to complete or fulfill the sweepstakes as originally planned.
List of winners will be posted on www.livekellyandmichael.com for at least 30 days after sweepstakes end date.
