GENERAL DESCRIPTION
As many as ten participants would receive a makeover. They would appear on LIVE WITH KELLY & MICHAEL ("LIVE" or the “Show”) for the makeover. LIVE reserves the right to vary any number of potential participants selected, if any. Any makeovers that might be performed would be subject to conditions set forth below.
SELECTION OF POTENTIAL PARTICIPANTS
Up to 25 potential participants would be selected on the basis of their photos (non-returnable), a letter no longer than one page (8½” x 11”) reflecting personality, creativity & potential for change. Participants would be selected from among the potential participants based on the above criteria and a possible phone call and makeover potential. LIVE staff, in their sole discretion, would select the participants. Decisions of the LIVE staff and makeover administrators are final and non-appealable on all makeover related matters. By submitting materials, participants agree to be bound by the decisions of the designated staff and makeover administrators and the guidelines. In the event of elimination from further participation for any reason, LIVE may, at its sole discretion, present the makeover opportunity to another participant.
ELIGIBILITY All participants, with proof presented, would need to be 18 years of age or older, a legal resident of the United States or Canada, with the exception of Guam, the Province of Quebec, Canada and where prohibited by law. Anyone who may be selected to participate must be available to appear on LIVE in New York between July 22 and July 31, 2015. Choice of exact date for any potential appearance would be at LIVE's sole discretion. If selectee is unable to appear on a designated date, selectee would be disqualified. Employees of American Broadcasting Companies, Inc., Buena Vista, LIVE, and their parent, affiliate, subsidiary and successor companies, and immediate family members/members of the same household of anyone so employed, are not eligible. Any submittor not abiding by these Guidelines would be eliminated from any further participation. HOW TO SUBMIT MATERIALS
All submissions must be received by NOON pm ET on Monday, July 15, 2015.
Individuals who want this makeover must send LIVE a short letter, one page or less, telling us why they need the makeover and a recent photo of themselves. Both photo and letter are non-returnable. Letter must be original work of Submittor and may not be previously published, and no third party may have any rights or claims to such materials. At LIVE’s sole option, submissions including note and/or photo may be posted on the Show’s website as well as any of the Show’s other social media pages and or sites. All submissions, whether mailed or submitted electronically, must be received in our office by 12 Noon ET on Monday, July 15, 2015 to be considered. Submitted materials will not be acknowledged or returned. All submissions, including without limitation photo and letter, become the property of LIVE, will not be returned or acknowledged, whole or in part, and may be used in any manner and in any media worldwide, in perpetuity.

There you will find instructions on the appropriate file formats and sizes for electronic submissions. Click on the e-mail address indicated and write your letter using your e-mail service, attaching the formatted photo.
LIVE can provide no technical support and accepts no responsibility for insuring the receipt of your essay and photo. If you experience any difficulties trying to submit your materials via e-mail, we recommend you send your letter and photo via U.S. mail to us at the above address.
IF A PARTICIPANT OPTS TO SUBMIT MATERIALS VIA FACEBOOK, HE/SHE MUST UNDERSTAND THAT THE CONTEST IS IN NO WAY SPONSORED, ENDORSED, ADMINISTERED BY OR ASSOCIATED WITH FACEBOOK AND FACEBOOK IS COMPLETELY RELEASED OF ALL LIABILITY BY EACH PARTICIPANT IN THIS CONTEST. SPONSOR HAS NO AFFILIATION WITH FACEBOOK AND NO RESPONSIBILITY FOR OR CONTROL OF ANY MATTERS RELATING TO FACEBOOK OR FACEBOOK ACCOUNTS. EACH PARTICIPANT UNDERSTANDS HE/SHE IS PROVIDING HIS/HER INFORMATION TO THE SPONSOR AND NOT TO FACEBOOK.
MATERIALS MAY NOT BE SUBMITTED EXCEPT FOR AS SET FORTH ABOVE. ANY MATERIALS SUBMITTED IN ANY OTHER FORMAT OR TO ANY OTHER ADDRESS WILL NOT BE CONSIDERED FOR POTENTIAL PARTICIPATION IN THIS SEGMENT.
All taxes associated with any items that may be received if participating in this makeover would be the sole responsibility of the recipient. An IRS Form 1099 must be issued for a participant who receives items, in total, with a value of $600 or greater. Each participant must sign an Affidavit of Eligibility, Indemnification and Release: (a) allowing LIVE, or any party it so designates, to use selected participant’s name, voice, image and/or submission materials for programming, promotional and publicity purposes; and (b) releasing and holding harmless American Broadcasting Companies, Inc., and Buena Vista Television and their respective parent, subsidiary and affiliated companies and their respective officers, directors, employees, heirs, assigns and agents, and any other participant in this promotion, (collectively, "Released Parties") from and against any liability, expense or claim arising from or relating to participation and/or appearance in this potential segment including, without limitation, travel to or from LIVE and/or acceptance or use of the makeover or any other item received as part of the potential segment. By submitting materials for consideration all participants agree to release, discharge and hold harmless Released Parties from and against any liability, expense or claim arising from or relating to participation in this search. Submittors selected for further participation agree to execute any and all additional releases or authorizations requested by LIVE. Failure to comply with any of the above will result in disqualification and forfeiture of any consideration received.
RESTRICTIONS
By submitting any materials the Submittor is agreeing to release, discharge and hold harmless American Broadcasting Companies, Inc., Buena Vista Television, their parent, subsidiary, affiliated and successor companies, advertising and promotional companies, any product suppliers that may become associated with this search and each of their respective officers, directors, employees, agents and representatives ("Released Parties") from and against any liability, damage or expense arising from or relating to participation in this search, attendance at LIVE, or any location designated by LIVE and/or acceptance or use of any item or action which may be associated with featuring the submittor, by the submittor, anyone else associated with the execution of the search or potential recognition of the submittor, and each of their heirs or assigns.
Submitting materials for possible use constitutes permission to use of submittor’s name, likeness, photograph, voice, biographical information and any materials submitted as part of this search for programming, publicity, promotional and/or other purposes in any manner, and in any media, without compensation, worldwide in perpetuity to the extent permitted by law.
LIVE is not responsible for late, lost, illegible, postage due, mutilated, incomplete, delayed or misdirected mail; for theft or destruction or unauthorized access to or alterations of submitted materials; for technical, network, telephone equipment, electronic, computer, hardware or software delays, interruptions or malfunctions of any kind, inaccurate transmission of or failure to receive submitted information by LIVE, or human error; for any injury or damage to submitor's or any other person's computer related to or resulting from submitting or downloading any materials in connection with the search.
If for any reason a Makeover Segment would become incapable of being run on-line as might be expected, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of the Show that corrupts or affects the administration, security, fairness, integrity or proper conduct of a Makeover Segment, LIVE reserves the right, at its sole discretion, to cancel, terminate, modify or suspend any portion of a Makeover Segment effected by such actions and/or to eliminate from participation any individual who tampers with any part of the submission process.
CAUTION: Any attempt to deliberately damage any Web site or undermine the legitimate operations of this search may be a violation of the criminal and civil laws, and should such an attempt be made, LIVE, or its designated representative, reserves the right to seek damages from any person associated with such actions to the fullest extent permitted by law. LIVE, or its designated representative, reserves the right to cancel or modify the search if it should become compromised in any way or if it becomes technically corrupted.
