LIVE’S THE HUNGER GAMES SWEEPSTAKES OFFICIAL RULES
NO PURCHASE NECESSARY.
I. SPONSORS: WABC-TV, American Broadcasting Companies, Inc. ("ABC"), LIVE with Kelly and Michael, ("LIVE" or “Show”) (hereinafter collectively referred to as "Sponsor").
II. ELIGIBILITY: Entrants must be 13 years or older and a legal resident of the 50 United States, the District of Columbia or Canada (except Quebec), and a Facebook user. If a minor is the winner, the minor must be accompanied by a parent or legal guardian (who will count as the additional traveling companion included in the prize). ENTRANTS MUST BE ABLE TO TRAVEL TO NEW YORK from Monday, November 18, 2013 to Friday, November 22, 2013. In the event an entrant is selected as a tentative winner and is unable to travel on the dates specified, then that entrant will be disqualified and an alternate winner will be selected. Winner must provide any and all valid and current identification necessary for the travel provided.
Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for ABC, LIVE or any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the contest or supplying the prizes, and their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to enter. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses. "Household members" shall mean people who share the same residence at least three months a year.
III. HOW AND WHEN TO ENTER: During the Contest Entry Period, (9AM ET Thursday, November 7, 2013 to Thursday, November 14, 2013 11:59PM ET), you can enter by…
1. Going to the www.facebook.com/LIVEKellyandMichael page, hit “LIKE” US and then click on The Hunger Games giveaway app and provide all information requested.
2. Follow the instructions provided to complete the registration process (name, address, contact telephone number, e-mail address, age) and fill out the entry form (“Entry”).
Mass entries or entries generated by a script, macro or use of automated methods will be disqualified. If for any reason the sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of the sweepstakes, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, modify or suspend the sweepstakes. If canceled, Sponsor reserves the right at its discretion to determine the winner using all non-suspect eligible entries received up to the time of cancellation. Sponsor is not responsible for failed, partial, delayed or garbled computer transmissions, or for technical failures of any kind in connection with entries or the entry process, including but not limited to electronic malfunction or damage of any network, hardware or software. In the event of a dispute over an electronic entry, prize will be awarded to the authorized subscriber of the e-mail account, not the name on the entry form.
Entries may be shared on social media with or without the official hashtag, however there is no official entry via hashtag.
By submitting an Entry, entrant hereby grants permission for his/her Entry to be posted on livekelly.com/, or www.facebook.com/LIVEKellyandMichael Facebook page or on the show . Sponsors, their representatives, agents, and/or and assigns, are not responsible for any unauthorized use by third parties of any Entry. Sponsor does not guarantee the posting of any Entry. If any person appearing in the Entry is under the age of majority in his/her state of residence, the parent or legal guardian is required to provide permission. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. By submitting an Entry, entrant warrants and represents that he/she and any persons appearing or who are identifiable in the Entry consents to the submission and use of the Entry in the Contest, and to their posting on the LivewithKellyandMichael Facebook page. Entries remain the property of Sponsor and will not be returned or acknowledged.
IV. HOW AND WHEN FINALISTS WILL BE SELECTED AND NOTIFIED:
Once all entries are in by the entry deadline of Thursday, November 14, 2013 11:59PM ET a winner will be chosen by random selection. Winner will be announced on Friday, November 15, 2013 or Monday, November 18, 2013, or as soon as a winner can be officially confirmed. Selected winner must respond to Sponsor within 24 hours or selected winner may be disqualified and another winner will be selected.
Odds of winning depends on the number of valid entries received. Final determination of finalists and winner is always conditional on verification of eligibility and compliance with all rules and procedures and providing any required releases.
V. PRIZES: The winner and guest will receive a trip to New York City including round trip airfare for two (2) (coach class) from a local airport selected at Sponsor’s discretion. Winner will also receive round trip ground transportation from and to the airport, and two nights hotel accommodations (one room, double occupancy). Winner will enjoy VIP seats to at least two of our shows where they will see some of the cast members and also attend an advance screening of “The Hunger Games: Catching Fire.”
Approximate retail value: $3,900.
All expenses not specifically provided for herein are the winner's sole responsibility. Some restrictions may apply. Federal, state and local taxes are the sole responsibility of the winner, who will receive an IRS Form 1099 reflecting the final actual value of any prize valued at $600 or more. Winners are not entitled to exchange or transfer prizes or to obtain cash or other substitutes, but Sponsor in its sole discretion may substitute prizes of equal or greater value.
Sponsor is not responsible for cancellation or preemption of show/contest/event/meeting, including but not limited to the featured guests on the Show that winner is selected to attend, or for other circumstances that make it impractical or impossible to fulfill these elements of the prize. These elements of the prize have no approximate retail value, and if it becomes impractical or impossible to fulfill this element, Sponsor’s only obligation will be to provide the remainder, if any, of the prize.
VI. RELEASES: By participating, entrants agree to be bound by these official rules and the decisions of the Sponsor/Judges and the staff of LIVE with Kelly and Michael, the contest administrator, which shall be final in all respects.
By participating in the contest and/or accepting any prize that they may win, entrants agree to release WABC-TV, American Broadcasting Companies, Inc., LIVE with Kelly and Michael, Lionsgate-The Hunger Games: Catching the Fire their respective parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in the contest and/or acceptance or use of any prize or portion thereof.
Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material for the Show or third-party advertisers related to the Sweepstakes, in any media now known or hereafter created or conceived, worldwide in perpetuity, or on a winner's list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor's sole discretion, without further obligation or compensation.
By submitting an entry-Entrants release the Released Parties from any actions, claims, injury, loss or damage allegedly caused, directly or indirectly, by any such statements or opinions made during a broadcast.
To claim prize winner must: (a) provide proof of winner’s age, residency, and legal status; (b) sign and return eligibility, publicity, liability, rules compliance and any other releases requested by Sponsor; and (c) have winner’s intended guest(s) or travel companion(s), if any, sign and return releases requested by Sponsor; all within the time period(s) specified by Sponsor.
VII. DISPUTES: Except where prohibited, entrant agrees that : (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court in New York, NY; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorney's fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
VII. MISCELLANEOUS; WINNERS' LIST: Void where prohibited. All federal, state and local laws and regulations apply.
Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify and/or suspend the contest in the event of tampering or other circumstances, including but not limited to acts of God or civil disturbance that render it impractical or impossible to complete or fulfill the contest as originally planned.
A winners list will be available on the website within 30 to 60 days of contest completion.
