LIVE’s “Oh Baby” Photo Contest Official Rules
I. NAME OF SPONSOR(S)
American Broadcasting Companies, Inc., WABC-TV, LIVE with Kelly and Ryan (“LIVE”) and Disney/ABC Domestic Television (Hereinafter collectively referred to as “Sponsor”) 77 West 66th Street, New York, NY 10023.
II. ELIGIBILITY
Entrants must be 18 years of age or older as of date of entry and legal resident of the 50 United States, the District of Columbia or Canada (except the Province of Quebec), with the exception of Guam, Puerto Rico and all other U.S. territories and possessions and where prohibited by law.
Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for American Broadcasting Companies, Inc., Disney/ABC Domestic Television, WABC-TV, LIVE with Kelly & Ryan, any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the contest or supplying the prize, and/or their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to nominate or be nominated. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses. "Household members" shall mean people who share the same residence at least three months a year.
III. HOW AND WHEN TO ENTER
NO PURCHASE NECESSARY.
Attend “LIVE” studio taping between Monday, April 2, 2018 and Monday, September 3, 2018. This contest will run in conjunction with “Live’s Dance Party Travel Trivia.” Upon entry to the studio, all eligible studio audience members will receive a numbered ticket, which will give them a chance to win a prize during the “Dance Party Travel Trivia” segment.
During each taping, one ticket number will be selected by the trivia caller or show host/representative, and that studio audience member will instantly win a prize.
In addition, the same prize-winning audience member will dance at his/her seat when his/her ticket number is called for “Live’s Show Us Your Moves Contest.”
The audience member must stand up and dance in his/her seat to be eligible for contest, and will have the option to officially enter in the dance entry pool.
On September 3, 2018, the dance entry pool will be narrowed down by the “LIVE” staff to the Top Five Finalists, and a public vote will determine one (1) grand prize winner.
Contest Entry Period: 9:00am ET, Monday April 2, 2018 to 10:00am ET, Monday, September 3th, 2018.
Limit (1) one entry per person.
IV. HOW AND WHEN WINNERS WILL BE SELECTED AND NOTIFIED
On Tuesday, September 4, 2018, five finalist dance entries selected by “LIVE” staff from the entry pool will be announced on the air. The criteria for selection at all stages of the contest, unless otherwise indicated, include: 1) Dance Skill (50%), 2) Entertainment Value (25%); and 3) Creativity (25%) (“Judging Criteria”)
Each Submission will receive a score based on the Judging Criteria for a maximum of up to one hundred (100) points. Sponsor reserves the right to select fewer than five Finalists, if in its sole discretion, it does not receive a sufficient number of eligible and qualified submissions.
All potential Finalists will be notified on the LIVE broadcast on Tuesday, September 4, 2018 between the hours of 9:00am ET and 10:00am ET. All potential Finalists will also be notified by email immediately following the broadcast.
Once the finalists are announced, public viewer voting will immediately begin and will end on Wednesday, September 5, at 6:00pm ET. To vote, viewers will vote for their favorite contestant. Every voting person may vote for only one contestant once per day. The link for Finalist voting will be published on KellyandRyan.com at 10:00AM ET, Tuesday, September 4, 2018. Limit one (1) vote per person per computer per day.
Grand Prize Winner Determination/Public Voting: Starting on Tuesday, September 4, 2018 at 10:00a.m. ET to Wednesday, September 5, at 6:00pm ET (“Public Voting Period”), up to five (5) Finalist dancing videos will be posted online for public voting by the general public (“Voter(s)”). Each Voter can vote based on the Judging Criteria for one (1) Finalist Video (“Vote(s)”) on each of the Show’s platforms: Website, Facebook page, Instagram site, and/or the Show’s Twitter site (see chart below) (“Public Voting”), for a total of up to 4 votes per day (1 per platform) and no more than 4 votes per 24 hours (1 per platform), per person. Voters must be thirteen (13) years of age or older as of August 31, 2018 and current legal residents of one (1) of the fifty (50) states of the U.S., D.C., or Canada (excluding Quebec).

Public Voting will count for 100% of the total score for each Finalist. Sponsor’s tracking and reporting system will account and log the Public Voting score for each Finalist. Each potential Finalist may Vote for his/her own Entry. If it is brought to the attention of Sponsor that a Finalist or a Voter has voted using any kind of script, vote rigging, voter exchanges, vote-buying, multiple accounts, repeat re-Tweets, Sharing, or Favoriting from any other platform or posts other than one (1) of the Show’s platforms listed in the chart above, or is otherwise in violation of these Official Rules, his/her Vote(s) will be disqualified.
All Votes must be received by Wednesday, September 5, at 6:00pm ET to be counted. Any attempted form of voting other than as described herein shall be null and void. The Finalist who receives the highest number of Votes from all four social platforms total will be deemed the Grand Prize Winner (subject to verification of eligibility and compliance with the Official Rules). In the event of a tie, Sponsor, in its sole discretion, shall choose the applicable Grand Prize Winner based on an evaluation of Video is superior overall. The Contest is in no way sponsored, endorsed, administered by or associated with Facebook, Instagram, and Twitter. Facebook, Instagram, and Twitter are completely released of all liability by each Entrant or Voter in this Contest. Sponsor has no affiliation with Facebook, Instagram, and Twitter and no responsibility for or control of any matters relating to Facebook, Instagram, and Twitter or Facebook, Instagram, and Twitter accounts. If an Entrant elects to enter with his/her Facebook account information, or a Voter opts to Vote on Facebook, Twitter, and/or Instagram, he/she is providing his/her information to the Sponsor and not to Facebook, Twitter and/or Instagram.
In the event of a tie at any stage in the voting process, the Entrant whose Submission receives the higher score for Creativity will be declared a Finalist. In the event of a further tie, the Entrant whose Submission receives the higher score for Overall Performance will be declared a Finalist. In the event of a further tie, the Entrant whose Submission receives the higher score for Enthusiasm and Personality will be declared a Finalist. In the event of a further tie, the Entrant whose Submission receives the higher score for Presentation will be declared a Finalist. In the event of a further tie, the Entrant who receives the higher score for Entertainment Value will be declared a finalist winner for that round. In the event of a further tie, Sponsor in its sole discretion shall choose a Finalist based on an evaluation of which contestant’s materials are superior overall taking all categories into consideration.
Grand Prize Winner will be announced on-air on or about Friday, September 7, 2018, between the hours of 9:00am ET and 10:00am ET. The Grand Prize winner will also be notified by email immediately following the broadcast. In the event the Grand prize-winner is deemed ineligible, fails to comply with contest procedures, or is unable to claim prize as specified, the Grand prize will be awarded to the second highest scoring Finalist, assuming timing allows.
Mass votes or voting generated by a script, macro or use of automated devices (“Mass Voting”) will be disqualified. Sponsor reserves the right to modify, suspend or cancel the Contest in the event: the Contest becomes infected by a computer virus or is otherwise technically impaired; and/or tampering, unauthorized intervention, fraud, technical failures, Mass Voting or other causes corrupt the administration, security, fairness, integrity or proper play of the Contest. If modified, suspended, or canceled, Sponsor reserves the right at its sole discretion to determine the winner using all non-suspect, eligible votes received up to the time of modification/suspension/cancellation using the judging procedure outlined above. Sponsor reserves the right at its sole discretion to disqualify any individual involved with, and/or void all associated votes it finds to be: tampering with the voting process or the operation of the Contest or related websites; intending to annoy, abuse, threaten or harass any finalist, Sponsor or any of its representatives; or to otherwise be acting in violation of the Rules. CAUTION: Any attempt to deliberately damage any website or undermine the legitimate operations of the Contest is potentially a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages and other such remedies from any such person to the fullest extent permitted by law.
Sponsor reserves the right to modify the voting mechanism, method and/or processes during the Contest to account for technical and production issues and to improve the user experience (including, without limitation, by adding to, changing or eliminating a method of submitting votes). Any such changes will be noted in a revision to the Rules and online.
Sponsor requires all entrants and finalists to act in good faith in all matters relating to the Contest and other entrants and finalists. To that extent any entrant, finalist and/or their Immediate Family Members act in a manner that: disparages or damages the Contest, entrants and/or finalists, via press, broadcast, online or any other means, including but not limited to deliberately encouraging others to vote against an entrant and/or finalist; employing or encouraging others to employ Mass Voting mechanisms; or in any way interfering with the planned Contest and voting procedures; is cause for disqualification from the Contest and/or the ability to vote in the Contest. This determination shall be made at Sponsor’s sole discretion and will be final.
By participating in this contest, each Finalist attests to the authenticity of his/her Entry and compliance with these Official Rules. Finalists are subject to verification of compliance with these Official Rules. Final determination of winner is always conditional on verification of eligibility and compliance with all rules and procedures.
V. PRIZE
One (1) Winner will receive a Grand Prize. The prize will be a vacation for two people at The St. James’s Club – Morgan Bay, St. Lucia valued at approximately $4985. (“Grand Prize”) Grand Prize package includes: six (6) days/ five (5) nights in a beachfront room for winner and one (1) travel companion (all expenses not specifically provided in St. James’s Club package is the sole responsibility of the Winner), Two (2) Roundtrip, coach fares for air travel from a major airport near winner’s residence (“airport of origin”) to be selected by Sponsor on a Sponsor-selected carrier (“Airline”). Winner must provide dates for Trip to Sponsor within three (3) months of drawing date and has one (1) year (until September 7, 2019) to take trip, excluding blackout dates. Some restrictions may apply. Meals are all inclusive, ground transportation from St. Lucia area airport to The St. James’s Club and return.
All expenses not specifically provided for herein are Winner’s sole responsibility, including but not limited to, food/beverages, round-trip transportation between the winner’s residence and the airport of origin; travel insurance; laundry service; spa treatments; alcoholic beverages; telephone calls; merchandise; souvenirs; incidental expenses, parking and tips and gratuities. Travel and lodging are subject to availability, certain restrictions, blackout dates and Sponsor’s approval. Airline carrier and hotel regulations and conditions apply.
Travel companions on any prize trip must be eighteen (18) years of age or older, or if a minor, must be accompanied by a parent or legal guardian. Travel companions will be required to sign and return a travel liability/publicity release prior to awarding of the prize. All travelers must travel together on the same itinerary and possess all required travel documents prior to awarding of travel prizes.
Approximate retail value (“ARV”) of the grand prize package is $4,985.00.
The ARV’s of all prizes are furnished by the prize suppliers.
Prize cannot be used in conjunction with any other promotion or offer. The prize winners shall be solely responsible for any applicable federal, state, provincial, local taxes and/or local laws and regulations, and the reporting consequences thereof, and for any other fees or costs associated with the prizes. Winner will receive an IRS Form 1099 reflecting the final actual value of any prize valued at $600 or more and must submit a validly executed IRS Form W-9 to claim prize. Winners must provide the sponsors with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded.
Prize vacation and vacation components may not be sold, traded, transferred, rescheduled to dates not within the fulfillment period set forth above, or refunded. Prize vacation is not redeemable for cash.
The ARV's of all prizes are furnished by the prize suppliers. For travel prizes where air transportation is included, the round-trip coach-class air transportation element of the prize begins and ends at a major commercial airport near winner's residence or in some cases from selected gateways as designated in the travel prize package. Sponsor reserves the right to structure travel route in its sole discretion. If winner elects to travel without a guest(s), no additional compensation will be awarded. If a Prize trip is outside the U.S. or Canada (if winner is a resident there), winner and guest(s) (if applicable) are solely responsible for obtaining all necessary travel documents including passports and visas. The U.S. State Department requires all international travelers to present a government issued passport for U.S. Customs re-entry after air, land or sea travel. For more information please visit the State Department's consular website www.travel.state.gov or the U.S. Department of Homeland Security's website www.dhs.gov. In the event that a prize component is not available during the time of the trip for whatever reason (e.g., weather conditions), then remaining elements of prize or prize components shall constitute full satisfaction of Sponsor's prize obligation to winner and no additional compensation will be awarded in lieu thereof. Prize winner and/or his/her travel guest(s) must have/present at least one major credit card in good standing in order to check into a hotel, cruise or resort. All other expenses and incidentals not specifically mentioned as being included are excluded and are winner's sole responsibility including, but not limited to, taxes, air transfers, government fees, unspecified ground transportation, meals, gratuities, hotel incidentals, telephone calls, port charges and taxes, government fees, shore excursion(s), souvenirs, gift shop purchases, spas, meals in alternate dining venues, travel documents, service charges and travel insurance premiums, trip and travel insurance, and required immunizations if applicable.
If the actual value of a prize is less than the stated ARV, the difference will not be awarded. Prize is not redeemable for cash or transferable, except it is transferable to a surviving spouse residing in the same household. No substitution allowed except, at Sponsor's sole discretion, a prize of equal or greater value may be substituted. Sponsor will not replace any lost, mutilated or stolen tickets, travel vouchers, certificates or prizes. Prize elements may not be separated. Airline tickets issued in conjunction with the prize are not eligible for frequent flyer miles, and no code share flights may be used.
In the event a traveler and/or his or her travel companions engage in behavior that (as determined by Sponsor in Sponsor’s sole discretion) is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip or other applicable experience early, in whole or in part, and send winner and travel companion home with no further compensation.
VI. RELEASES
By participating, entrants agree to be bound by these official rules and the decisions of the Sponsor, Judges and/or the contest, administrator, which shall be final in all respects.
By participating in this contest and accepting any prize that they may win, entrants agree to release Buena Vista Television, LLC, American Broadcasting Companies, Inc., WABC-TV, LIVE with Kelly & Ryan, Disney/ABC Domestic Television, and their parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns, and Facebook, Instagram, Twitter (collectively, the “Released Parties”) from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this contest and/or acceptance or use of the prize.
Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, in any media now known or hereafter created or conceived, worldwide in perpetuity, or on a winner’s list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation.
By submitting entry materials, entrants certify that such materials are original and created by entrant, that entrants have the necessary rights, permission and authority to submit such materials, and, if applicable, that entrants maintain a valid copyright in the materials. Entrants acknowledge that such materials may be included and/or discussed in a broadcast, that such discussion may include statements or opinions by the broadcast talent or others about the entrants, the entrants’ appearances and/or the materials, and that those statements and opinions may be considered surprising, humiliating, embarrassing, derogatory, defamatory or otherwise offensive or injurious to them, Sponsor’s employees, its studio or at-home audience and/or other third parties. Entrants release the Released Parties from any actions, claims, injury, loss or damage allegedly caused, directly or indirectly, by any use of the materials and/or such statements or opinions made in connection with them during a broadcast.
To claim prize, in additional to the notification and release requirements described above, (a) winner must provide proof of age, identity and residency, (b) winner must sign and return affidavit of eligibility/compliance with rules, publicity/liability release and indemnification all within the time period specified by Sponsor.
VII. MISCELLANEOUS; WINNERS’ LIST
Void where prohibited. All federal, state and local laws and regulations apply.
Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify and/or suspend the contest in the event of tampering or other circumstances, including but not limited to acts of God or civil disturbance that render it impractical or impossible to complete or fulfill the contest as originally planned.
List of winners and these rules will be posted on www.livewithkellyandmark.com for at least 30 days after winners are finally determined.
